COMPLETE CONTEST RULES
1. WHO MAY ENTER: This contest is offered and open to anyone over the age of eighteen (18). Employees, officers and directors of Motor Mart, its agents, and members of their immediate family (spouse, children, siblings, parents) or persons living in the same household (whether or not related) are NOT eligible. Groups, clubs, organizations, commercial entities, and businesses are NOT eligible. By participating, you agree to these Official Rules and to all decisions of Sponsor, which are final and binding in all respects.2. SPONSOR: The Joseph Company, doing business as The Motor Mart, 1406 Pittsburgh Street, Cheswick, PA 15024.
3. CONTEST PERIOD: Contest period begins on April 30, 2010 and ends on May 30, 2010.
4. HOW TO ENTER: Clip out the Entry Form in the Free Motor Mart Magazine, fill it out completely and mail it to: The Motor Mart - Contest Entry, 1406 Pittsburgh Street, Cheswick, PA 15024. Or use the online entry form at http://freemotormart.com. No purchase is necessary to enter or win. Purchase will not improve your chances of winning. Entries are limited to one per person. Multiple entries will void all entries. Only one winner per household is permitted and no person may win a contest more than once every (3) months.
5. PARTICIPATION AND WINNING: To participate, Entrant must fill out and submit an original contest form in the magazine or online. Sponsor is not responsible for any entries that are misdirected, lost, disconnected and illegible or are not received. Entries received that are mutilated, tampered with, illegible, or from ineligible entrants will be void. Entries that are determined by the Sponsor to be fraudulent will be void. All entries become the property of Sponsor and will not be acknowledged or returned. Winners will be notified in writing of the requisite procedure to claim the prize. Prizes will be released to winners only. Winners are required to have a valid government issued photo ID and social security number to receive any prize.
6. PRIZES AND ODDS: There will be five $100.00 prizes awarded. The odds of winning a prize are dependent on the number of entrees received at the Motor Mart Magazine.
7. PUBLICITY: Winners may be required to complete, execute and return a Liability Release and a Publicity Release prior to receipt of any award. In the event winner fails to timely return documents in compliance with these Official Rules, disqualification may result. By accepting a prize, where permitted by law, winner grants to Sponsor and its agents the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web, at any time or times, the winner's full name, photo, picture, portrait, or other likeness, voice and indicia of persona, and biographical information as news or information, and for advertising, trade, and promotional purposes without additional compensation or consideration, and without notification, review or approval. By participating in this contest, Entrant agrees to allow Sponsor to include Entrant's name and address in a list of winners that will be available to the public on demand. Sponsor will not share any other personally identifiable information to person's requesting a list of winners unless ordered or compelled to do so by process of law.
8. DISPUTES: Sponsor shall be the sole arbiter in all matters relating to the contest and the interpretation of contest rules. Sponsor's decisions shall be final. Entry into this contest constitutes agreement by contestant to abide by these rules, as well as any other specific contest rules established by Sponsor. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this contest or any prizes awarded shall be resolved individually and exclusively by the Court of Common Pleas of Allegheny County, Pennsylvania; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest but in no event attorneys' fees; and (iii) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.
9. DISQUALIFICATION: Sponsor reserves the right, at its sole discretion, to disqualify any individual from the contest that it finds, in its sole discretion, to be tampering with the entry process, the entry form, or the operation of the contest; to be acting, or be, in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or interfere in any manner with any aspect or portion of this contest.
10. MISCELLANEOUS: Any attempted participation by means other than those permitted by these Rules is void. Sponsor and any participating contest agencies or prize providers will not be responsible for lost gift cards. Unclaimed prizes will not be awarded. Entry contestants, by participating (and winners, by accepting a prize) release Sponsor, its parents, subsidiaries, and its respective board, partners, vendors, agents, representatives, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the contest and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize.
11. WINNERS LIST: For the name of the winners, if any, send a self-addressed first class stamped envelope to: The Motor Mart, 1406 Pittsburgh Street, Cheswick, PA 15024, with the words "Winners List" on the return envelope. Only winners who request and receive their gift cards will be listed.
12. PRIVACY: Sponsor will be collecting personally identifying information from persons who submit entries. Only certain of that information, such as the person's name and city and state of residence, will be published to those persons requesting a winners list.
13. TAXES: All contest winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. Government rules governing withholding and gift tax can change without notice. ..
